Failure to Perform the Duties of a Driver involving injured persons can be either a class C felony carrying a maximum penalty of 5 years in prison or $125,000 in fines or a class B felony carrying a maximum penalty of 10 years in prison and $250,000 in fines if the accident results in serious physical injury. A conviction also carries a mandatory driver’s license revocation for 5 years.
